The terms and conditions define our procedure for using, collecting, retaining, disclosing and protecting of your personal information.

REVISION POLICY

The designers working at Creative Shark provide revisions in case you are not satisfied with our work. The number of revisions allowed depends on the package selected, giving you the right to demand the allotted number of revisions with no extra charges. Creative Shark is committed to delivering top-notch customer service with revisions if our customers need it. We believe in design excellence and make sure our clients are always satisfied with work.

TURN AROUND TIME

The word turnaround time, in any case, does not include the complete design and development cycle from start to finish of a project, rather it simply specifies the time duration of a single iteration of a design stage. Creative Shark has a 48-72 hour turnaround time for all kinds of design and development services that have been further explained in our packages.

REFUND POLICY

The refund policy presented by Creative Shark is applicable on all its design and development service.

The refund policy of Creative Shark will be void if:

  • A special or custom design and development package is selected by the customer
  • Rejecting the design after approving the initial design
  • The logo designs have been finalized and approved from your side
  • The design of the website has been approved, developed and deployed live
  • Revisions have been already provided by our side
  • Any kind of cancellations taken place due to non-project reasons
  • No contact with us for more than 2 weeks
  • Violation of Creative Shark’s policy or policies
  • The creative brief lacks essential requirements or information
  • A complete design change has been demanded
  • The claim for refund has been made after the requested time
  • There is a change in business or brand name
  • Other reasons such as change of mind, disagreement with other partners or etc. are also not catered
  • Revisions have been accepted at your hand.
  • If a client subscribes for a service bundle and happens to be dissatisfied with a particular service, the refund will only be applicable on that particular service and ‘not’ the entire bundle.
  • The cancellations of orders are prior to a 33% cancellation administrative fee.

Note: Creative Shark holds all the right to cancel or reject any project at any time. Further, after the refund, all the designs will be the sole property of Creative Shark and the client will have no right to use those designs for any purpose.

The services which are not related to design or development are not included in the refund policy under any situations. Creative Shark might provide custom services as a part of any package or deals, however, charges for such services are refundable. Examples of such services include:

  • Email and website hosting services
  • Website SSL and copyrights protection certificates
  • Purchase of website domain
  • Social media marketing, Google Adwords campaigns or website SEO plans
  • Website maintenance plans

In case of dissatisfaction of any of the above-stated services which are not covered by our refund policy, Creative Shark will conduct a project assessment and evaluation, make a decision depending on the circumstances; it may choose to refund all or partial money back to the client, or reject it altogether.

CLAIM YOUR REFUND

Once Creative Shark has agreed to refund the money, it is the duty of the customer to claim his/her refund through the following certain steps:

  1. Initiate the refund process
  2. Call our number to get in touch with a customer representative or project manager to begin the refund process.
  3. Another way of claiming refund could be sending us an email.
  4. Creative Shark’s customer representative can also be contacted through live chat and they will initiate your refund process.
  5. As soon as we receive your refund request, we will start the process and respond to you at our earliest.
  6. A project analysis will be conducted
  7. After completion of the assessment, the refund policy process will be followed.

Note: In order to receive full refund, the refund request for the cancellation of the order placement must be made within 24 hours of order placement. Failing to do so, our cancellation service fee charge will be applied.

Once you have received your refund, you will have no rights to use any designs. Creative Shark is the righteous owner of all the designs, until and unless mutually agreed by the customer and Creative Shark.

All designs created by the Creative Shark’s designers undergo detailed research and scrutiny, ensuring the quality and uniqueness is maintained throughout. Our free multiple revisions allow us to achieve a 100% satisfaction rate. We will revise the ordered design and keep on revising it until you are completely satisfied.

DESIGN OWNERSHIP & RIGHTS

Once the artwork is accepted by the client, we are bound to send the final file as soon as the client completes the payment process. After completion of the design process, the client owns all the rights of the paid artwork. All the claims and copyrights of the design are then transferred to the client.

  • 100% ownership rights of the finalised design belong to the client.
  • The client is free to use the finalised design as they see fit.
  • Client shall not, however, own any materials, media or other content generated during any revision cycles leading up to the Final Product.

DELIVERY POLICY

Creative Shark will send the complete file and design on the account provided by the client, an order confirmation email will also be sent to the mentioned account on the date when the project started. Although the turnaround time depends on the package selected by the consumer, the minimum time required by Creative Shark team is 2 business days. All procedures pertaining to revision & refund are subject to date and time of the design order and will be delivered to the account provided by the client.

Websites will only be made live once all dues have been cleared. If the payment is not clear, under no condition Creative Shark will make the website live.

COPYRIGHTS & TRADEMARKS

Customers have the full ownership of the logos and other designs made by our designers including the drafts, final design and all related materials. The web site retains the right to use the logos and other design exclusively for promotional purposes, such as a part of our portfolio.  We promise to use the logos and designs in a fair and legal manner which does not damage the client’s reputation and integrity.

RECORD MAINTENANCE

Creative Shark keeps a record of all the designs crafted by our team of designers, we keep a copy of your finalised design even after we have submitted the final file.

If you require the final files again in the future we can send them to you at your request.

CUSTOMER SUPPORT

Our Customer Support Team is available 24/7 online to answer all of your concerns and queries. You can also send an email to us with all your queries and our customer representatives will get back to you shortly.

CONTENT CREATION & POPULATION

Creative Shark will not be responsible for creating or populating content (e.g. text/Images) into the website, unless purchased exclusively otherwise. In which case:

  • Creative Shark will populate the website with content created for the client
  • The content/text for the website will be created specifically for the customer’s website
  • Creative Shark will acquire stock imagery from stock photo websites just for the client
  • Images will be purchased upon approval from the client and the price will be charged for it
  • Creative Shark will not be responsible in any way, shape or form, for any similarities between images used on the site that may or may not resemble other websites
  • Creative Shark will populate the website with products and product details
  • Product images and product details must be provided by the client

FEES FOR CREATIVE SHARK SERVICES

Creative Shark reserves all the right to change the prices of any service provided by us without any prior notice, although the changes will be mentioned on our website under the individual product/service heading. By accepting these terms and conditions, the client agrees to pay the mentioned prices against our services. The members of Creative Shark will communicate the amount being charged for services to the client before the beginning of the project as an acknowledgment statement.

TECHNICAL SUPPORT

Creative Shark is a digital design agency focusing on providing design and development services meeting client’s needs. Sometimes, our packages will include technical stuff which is provided by us to help the client achieved the desired results with their websites and logos. Creative Shark will provide all the basic information regarding services and will work with the client in order to set up, ensuring successful completion. However, Creative Shark will not be responsible for providing detailed training or installations of said services on the Customer’s end.

Creative Shark will not be liable or responsible in any way for customer’s failure to execute, install or learn the usage of above-said services, complete responsibilities lie on the shoulder of the customer.

MODIFICATION

Creative Shark has the right to modify terms and conditions, privacy policy, services and content offered or published on our website at any given time, without prior notice. In short, Creative Shark holds full right to change or modify any content on the website without any prior notice.

COMMUNICATION POLICY

All Feedback Requests, Revisions Requests, Refund Requests or any other instructions that pertain to the order must be clearly stated by the client to our customer representatives or the project manager. Emails sent back and forth through official emails are to be only considered forms of valid communication. We are not responsible for any damages, issues or delays caused due to contacts made through unofficial communication means. We take full responsibility for all the information provided through our official domains.

PAYMENT

Creative Shark provides paid services and/or products on our website, for which we partner with third-party monetary service providers who acquire your personal details in order to complete the payment process. All these institutions adhere to the high standards set by the security standards council, ensuring your peace of mind.
